Is your K-3 petition still pending?

If you are a U.S. citizen who filed an I-130 and an I-129F for your husband or wife and you are still waiting, tell us where your case stands. Attorney Simone Bertollini is collecting information from K-3 petitioners to evaluate possible federal court action.

This page is for spouse (K-3) petitions only, not K-1 fiancé(e) petitions.

In August 2026 our office filed Jimenez v. Mullin, No. 3:26-cv-01384 (D. Conn.), a federal lawsuit over the government’s handling of K-3 petitions. After the case was filed, USCIS approved the plaintiff’s pending I-130 petitions, including two for his stepchildren that had been pending only about four months. Prior results do not guarantee a similar outcome.
